Oshkosh, Wisconsin Building Codes

Overview

The City of Oshkosh adopted the state residential codes including SPS 320 through 325 and the commercial code SPS 360 through 365 with amendments. Oshkosh Municipal Code, Chapter 7 Buildings § 7-34 (accessed 7/1/2014). Although the state residential code applies to  new construction, additions and alterations for buildings constructed after 1980, Oshkosh code extends it to additions and alterations on pre-1980 buildings with exceptions such as adding a second exit for a second floor. Id. Wisconsin has an existing building code for commercial buildings, SPS 366. Surprisingly, the Oshkosh adoption did not include SPS 366; however, the law would still apply under state law.

 

With regard to permits, the code provides:

 

SECTION7-30 MINOR REPAIRS EXCLUDED

All work which affects the occupancy, area, structural strength, fire protection, exits, light, or ventilation of the building, requires a Building Permit. Minor repairs or alterations which are less than One Thousand Dollars ($1,000.00) in value do not require a permit if they do not affect the occupancy, area, structural strength, fire protection, exits, light, or ventilation of a building.

Wisconsin adopted the 2009 IBC. It applies to "code applies to all public buildings and places of employment" with certain exception. Wis. Admin. Code § SPS 361.02. The Code defines "public buildings" and "places of employment." Id. Additional requirements and amendments can be found in Wis. Admin. Code § SPS 362.

Wisconsin adopted the 2009 IEBC, subject to the modifications specified in chapter § SPS 366.

The city of Oshkosh, Wi. provides certain grandfathered ordinances (variances to the CBC). An ordinance that is grandfathered has passed the requirements laid out by the Legislature in Wisconsin Statute §101.02(7r)(b). The grandfathered ordinances are listed below:

(A) The following rules and regulations together with any future additions, deletions or supplements thereto, are herewith incorporated as part of this Chapter and shall be enforced with the same force and effect as though set forth in full herein. Providing, however, that where such rules and regulations are less stringent than other provisions found in this Code, the provisions of this Code shall apply.
